Two Killed in Crash on I-40

A pair of women from Kingston were recently killed in a tragic auto accident on Interstate 40 East close to mile marker 372 near Campbell Station Road, the Tennessee Highway Patrol reports. Authorities say an individual stopped his van on the shoulder of I-40 East when a 74-year-old female driver drove her Honda CRV into the back of the Nissan van.

The driver and the 53-year-old occupant of the Honda CRV were killed in the impact. The Nissan driver was hurt in the impact, although authorities have not released any information on his condition. Reports suggest neither drugs nor alcohol were factors in the crash.

The accident backed traffic on the busy interstate up for miles, causing delays for hours. All of us at our firm send our condolences to the victims’ families. As a law firm that regularly represents the legal interests of auto accident victims, our lawyers understand the impacts these types of events can have on survivors who depended on their loved ones for emotional guidance and financial support.

Proving fault in an auto accident

While the investigation into the accident is still ongoing and authorities have yet to release more details into the case, there are certain factors in auto accidents parties can look into in order to ascertain liability in a crash. Following an accident, police, fire and EMS investigators, insurance claims adjusters, and lawyers will scrutinize the event to ensure certain legal interests are satisfied.

  • Police and EMS auto accident investigations – Immediately following an auto accident, authorities will be among the first to look into a crash. As public safety officers, police will create reports detailing the accident after an investigation.
  • Auto accident claims – Insurance plays an important role in auto accidents. Most states, including Tennessee, require drivers to carry car insurance to operate vehicles and pay compensation to victims for their property damage and medical bills. While these adjusters may rely on a police report to assign liability, they may reach different conclusions, often times in their own self-interests.
  • Law firm auto accident investigations – When insurance companies fail to pay proper claims to auto accident victims, they may rely on their own legal counsel to look into who caused the crash and file claims for damages if necessary.

Despite the requirements to do so, insurance companies are not in the business of paying claims and taking care of victims. These companies make money by collecting premiums and defending claims that seek payment. Sadly, this common practice often delays the necessary compensation victims and their family members need to make themselves whole again and move on with their lives.
